Successful appeal meant employee had not been dismissed

The Court of Appeal has agreed with the Employment Appeal Tribunal that an employee whose appeal against a gross misconduct dismissal was successful had not been dismissed so couldn’t claim unfair dismissal. Is this decision good news for employers?
